Terms of Service

99exams.ai ("we", "us") provides software that lets independent educators ("creators") build and run their own exam-practice websites, and lets students ("learners") practise on those sites.

By creating an account, building a site, or using a creator's site, you agree to these terms. If you use 99exams.ai on behalf of a company or organisation, you confirm you are allowed to accept these terms for it.

If you do not agree, please do not use the service.

• Platform: the 99exams.ai software, dashboard, websites and APIs we operate.
• Creator: a person or business that uses the platform to publish question banks, exams and a site, and to sell access to learners.
• Creator site: a creator's website on the platform, at a 99exams.ai address or the creator's own domain.
• Learner: a person who signs up on a creator site to practise.
• Content: anything uploaded to or created on the platform, including documents, questions, answers, explanations, images and text.

You must give accurate information when you sign up and keep it up to date. You are responsible for keeping your password safe and for everything that happens under your account. Tell us straight away at security@99exams.ai if you think someone else has accessed it.

You must be at least 13 years old to create an account. Learners under 13 may only use a creator site with the consent and supervision of a parent or guardian (see our Privacy Policy at 99exams.ai/privacy).

Creators may invite teammates to their workspace. The creator who owns the workspace is responsible for what their teammates do in it.

We provide software: tools to upload and organise questions, build exams, design a site, manage learners and connect a payment provider. We are not a publisher, school or exam board, and we do not write, check or endorse creators' content.

Creators are the sellers of their own products. When a learner buys access on a creator site, the sale is between the learner and the creator, and the creator is the merchant of record. That means the creator sets prices, is responsible for the sale, for taxes on it, for receipts and for customer service.

We take 0% platform commission on creators' sales. We earn money from the plan the creator pays for, not from a share of their revenue.

Learner payments are processed by third-party payment providers that the creator connects, such as Salla or Stripe. We do not hold creators' sales money and we never see or store full card numbers.

Each provider has its own terms, fees and payout rules, and those apply to the creator's use of it. Fees charged by a payment provider are separate from our plan price and are not controlled by us.

If a payment provider suspends a creator's account or delays a payout, the creator must resolve that with the provider.

Creator plans are billed monthly and are priced by the number of active learners on the creator's site in that month. Plan limits and prices are shown on 99exams.ai/pricing and in the dashboard.

• We never charge automatic overage fees. If a site reaches its active-learner limit, we will tell the creator and ask them to upgrade; we will not add surprise charges.
• Upgrades take effect straight away. Downgrades take effect at the start of the next billing period.
• You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Plan fees already paid are not refundable unless the law requires otherwise or we say so in writing.
• Prices may not include taxes such as VAT, which will be added where required.

We will give at least 30 days' notice before changing the price of a plan you are on.

Creators keep ownership of their content. By uploading it, the creator gives us a limited licence to store, process, display and deliver it only as needed to run the platform for them and their learners.

If you are a creator, you promise that:

• you own your content or have permission (a licence) to use and sell it;
• you will not upload leaked, stolen or confidential exam questions, or material copied from copyrighted question banks, books or courses without permission;
• your content does not break the law or anyone else's rights, including privacy and trademark rights;
• you will describe your products honestly and not claim to be affiliated with an exam board unless you are.

Creators are responsible for the accuracy of their questions, answers and explanations. Our tools can extract questions from documents automatically, and that extraction can be wrong: it can miss text, mix up options or attach the wrong answer. Answers are never verified automatically. Questions marked as needing review or with an unknown answer stay that way until the creator checks them.

Anyone can report content they believe infringes copyright, leaks a real exam or breaks these terms using the form at 99exams.ai/report. Please include enough detail for us to find the content and understand the problem.

We review reports and may remove or disable content, notify the creator, and ask for their response. Creators who believe content was removed by mistake can reply to our notice with an explanation.

We will close the accounts of creators who repeatedly infringe others' rights.

Each creator site is run by an independent creator. When you sign up on a creator site, your account and progress belong to that site, and what you can access depends on what the creator offers and what you have bought.

• Purchases are made from the creator, not from 99exams.ai. Refunds are handled by the creator under their own refund policy. If you need a refund, contact the creator first.
• Access you buy is for your personal use. Do not share your account, resell access, or copy, scrape or publish questions from a creator site.
• Practice scores are estimates to help you study. They do not predict or guarantee a result in any real exam.

If you have a problem with a creator that you cannot resolve with them, you can contact us and we will try to help, but we cannot guarantee an outcome.

Everyone using the platform agrees not to:

• break the law or help someone else do so;
• upload malware, or try to probe, overload or break into the platform or other users' accounts;
• scrape, copy or bulk-download content, or use automated tools to access the platform, except through our published APIs;
• harass, threaten or deceive other people, or impersonate anyone;
• use the platform to sell anything other than educational content and services;
• get around plan limits, security controls or payment flows.

Some features use artificial intelligence, for example extracting questions from documents, drafting explanations, translating or tutoring. AI output can be inaccurate, incomplete or out of date, even when it sounds confident.

• AI output is a starting point, not a final answer. Creators must review it before publishing; learners should check it against reliable sources.
• AI output is not professional advice of any kind, including medical, legal or financial advice.
• Medical and health-related exam content on the platform is for education and exam preparation only. It must not be used to diagnose, treat or make decisions about any real patient.

We do not use creators' private question banks to train AI models.

The platform, its software, design and the 99exams.ai name and logo belong to us or our licensors. These terms give you a right to use the platform as described; they do not give you ownership of it.

If you send us feedback or ideas, we may use them without owing you anything.

You can stop using the platform and close your account at any time.

We may suspend or close an account, or remove content, if we reasonably believe it breaks these terms or the law, puts other users or the platform at risk, or if we are required to by law or by a payment provider. Where it is reasonable and allowed, we will tell you why and give you a chance to fix the problem first.

If a creator's account closes, their site goes offline. Creators can export their content from the dashboard before closing; we keep data afterwards only as described in our Privacy Policy.

We work hard to keep the platform reliable, but we provide it "as is" and "as available". To the extent the law allows, we do not promise that it will always be available, error-free or suitable for a particular purpose.

We are not responsible for creators' content, products, prices, refunds or conduct, or for the services of third-party providers such as payment processors.

To the extent the law allows:

• we are not liable for indirect or consequential losses, such as lost profits, lost revenue, lost data or damage to reputation;
• our total liability to you for any claim related to the platform is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you have not paid us anything.

Nothing in these terms limits liability that cannot legally be limited, such as liability for fraud.

If someone makes a claim against us because of content you uploaded, products you sold, or your breach of these terms or the law, you agree to cover our reasonable costs and losses from that claim.

We improve the platform over time and may add, change or remove features.

We may update these terms. If a change is significant, we will tell creators by email or in the dashboard at least 30 days before it takes effect. The date at the top of this page shows when the terms last changed. If you keep using the platform after a change takes effect, you accept the updated terms.

These terms are governed by the laws of [Kingdom of Saudi Arabia — confirm with counsel].

If you have a concern, please contact us first so we can try to resolve it informally. If we cannot, disputes will be handled by the competent courts of that jurisdiction, unless the law where you live gives you the right to bring a claim locally.
